On my way home from work today i was sitting at a red light, just before the light changed the car behind me randomly floored it into my car. The damage could be worse, but the bumper is bent, rear pannel is smashed, and the quarter panels on both sides are tweaked. Other than having my receipts ready, Any suggestions on how to deal with the insurance? Also based on everyones experience do you think the insurance will total the car?

Man that really sucks. Their insurance should pay obviously. Looks to be worth more than the damage from where I sit, keep in mind I'm an amateur with ins. co's.

Yah, they'll probably try to total it. They tried to total mine for this and said my car was worth 4500 bucks. I told em to shove it where the sun dont shine!! This was the at fault parties insurance. My insurance was polite, paid the claim quickly, and all was well! So it just depends. Good luck and dont give up!

Bummer.  I would guess they will try to total it - they usually do (when its more than a fender bender - which the roadhoag's car appears to be).  Usually when you see a car hit real hard from behind the sheet metal above the center of the wheel will be buckled which generally indicates more serious damage.  I don't see that on yours - at least on the one side of the pic.  It could be as easy as a new back panel.  Hope it works out.  

 

No one should be surprised or shocked (wake up if you are) that insurance companies try to total these cars when they get hit - it doesn't work for them financially to fix them.  I get an "offer" every year from whatever dickweeds here in california to take my Mercedes 190 16v valve off my hands for $500 "to get it off the road".  Get serious.

It is buckled on both sides right above the wheels. it isnt all that noticable but the paint is cracked and it definately has damage there.

I have usaa, the person who hit me has state farm. Just to be safe i also got a short video of her admitting that the wreck was her fault.

I own a body shop and deal with insurance companies everyday.

The insurance will attemp to get a going market value in your area , and then compare the cost of the repairs to the going market value in your area. if the repair is more then 60-70 % of the market value then they will total your car. However if it is totaled you can still buy the car back at a small fraction of the totaled cost.

Let's say the insurance determines its a total loss and pays you $16,000. You might be able to buy it back for $2,000-$2,500 range. Just keep your cool and explain to your claim adjuster you love your car and are willing to buy it back if it is a total loss.

As for the repair, most shops are just gonna do a light pull without replacing/ cutting out any metal , So don't expect a big fat bill.

The damage can be fixed easily. That's the good news. I guess around $3,400-$5,000 range depending on which region you live in.

Do you then end up with a "salvage" title? If so, what will that do to the value of the repaired car, or how will that play if/when he decides to sell the car?

You would end up with a salvage title only if the insurance company decides to total the car. As others said, get comps of what tii's are going for and fight any attempts by State Farm to total the car. They will probably look at the value of a regular 02 and don't know what a tii is. .I've been seeing 74 tii's going for over 30K lately so if the bill is $4K, the insurance company should fix it.  Been there, done that when my former 74 2002 was rear ended on the 10 freeway in So Cal. Do not let the insurance company tell you where to get your car fixed. Tell them the shop that will do the work.

 

I did that when my car, without me, rolled down my driveway into the woods and did over 2K in damage. My ins. co. was fine with it, the body shop was even able to get more money from the adjuster for the repairs.
